Please read these Terms and Conditions before using this website or placing an order. By browsing this site, buying from us, or booking workshop work, you agree to be bound by them. If you do not agree, please do not use the site or our services.

1. Who we are

This website is operated by NZ Tuning Limited, trading as NZ Performance Tuning, NZBN [9429033676869], a company registered in New Zealand.

Our workshop and trading address is Unit 5 / 88 Hobsonville Road, Hobsonville, Auckland 0618, New Zealand.

We sell automotive performance parts, and we provide ECU remapping, DSG transmission tuning, diagnostics and related workshop services. In these Terms, "we", "us" and "our" mean NZ Tuning Limited.

2. Using this website

You confirm that you are at least 18 years old, or that you are using this site with the supervision of a parent or guardian.

You agree to use this site only for lawful purposes. You must not use it to transmit unlawful, harmful or fraudulent content, attempt unauthorised access to any part of the site or its systems, or interfere with its proper operation.

3. Products, fitment and pricing

All prices are shown in New Zealand dollars and include GST unless stated otherwise. Prices are subject to change without notice.

It is your responsibility to confirm that a part fits your vehicle before ordering. Vehicle specifications vary by market, model year and build date. If you are unsure, contact us before you buy and we will check it for you.

We aim to keep all product descriptions, specifications, images and availability accurate, but we do not warrant that they are free of errors. We reserve the right to correct errors, and to modify or discontinue any product at any time.

We are not liable for typographical errors in pricing. If a pricing error occurs, we may cancel any affected order. If you have already paid, you receive a full refund.

4. Performance figures and product claims

Any power, torque, dyno or performance figures quoted on this site, or supplied to us by a manufacturer, are indicative only. Actual results vary with vehicle condition, mileage, fuel grade, ambient conditions, supporting modifications and vehicle specification.

We do not guarantee that your vehicle will achieve a specific figure.

5. Modified vehicles, warranty, insurance and legal compliance

Fitting aftermarket parts or modifying engine or transmission software may affect your manufacturer warranty, your insurance cover, and your vehicle's compliance with New Zealand road and certification requirements, including Warrant of Fitness and Low Volume Vehicle certification where applicable.

By ordering parts from us or booking tuning work, you acknowledge and agree that:

  • You own the vehicle, or you have the express authorisation of the registered owner to modify it
  • Increased performance may increase wear on engine, driveline and braking components
  • It is your sole responsibility to confirm the position with your insurer, your vehicle manufacturer, and where relevant an approved vehicle inspector or certifier, before proceeding
  • It is your sole responsibility to ensure your vehicle remains legal for use on public roads

Where a product is intended for competition, track or off road use only, this is stated on the product page. You must not use those products on a public road.

6. Orders and payment

By placing an order you confirm that the information you provide is accurate and complete.

We accept Visa, Mastercard, American Express and UnionPay, along with Shop Pay, Apple Pay and Google Pay. Other payment methods may be shown at checkout. The methods available to you are always displayed at checkout before you pay.

Payment is required in full at the time of purchase for online orders. For workshop services, payment is due on completion of the work and before the vehicle is collected, unless we have agreed otherwise in writing.

Your order is an offer to buy. It is accepted once we confirm it by email. We may refuse or cancel any order at our discretion, including where stock is unavailable, where a pricing or listing error has occurred, or where we suspect fraud. If we cancel an order you have already paid for, you receive a full refund.

Card payments are processed by our payment provider through a secure, PCI compliant connection. We do not store full card numbers.

7. Shipping, delivery and collection

Shipping costs are calculated at checkout based on your delivery address and the size and weight of your order. The exact amount is shown to you before you pay. Free collection from our Hobsonville workshop is also available at checkout.

Delivery timeframes, carrier options, handling times and the process for delayed, incomplete or lost orders are set out in our Shipping Policy, which forms part of these Terms.

Risk in the goods passes to you on delivery, or on collection where you choose to collect.

8. Returns and refunds

Our returns process, return window, restocking fee and refund timeframes are set out in our Returns and Refunds Policy, which forms part of these Terms.

Because of the nature of ECU remapping, DSG tuning and other software and labour services, specific conditions apply to those services. These are set out in the Returns and Refunds Policy.

9. Your rights under New Zealand consumer law

Nothing in these Terms limits or excludes your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply to you.

Where you acquire goods or services from us for the purposes of a business, and to the extent permitted by section 43 of the Consumer Guarantees Act, the guarantees in that Act do not apply.

10. Intellectual property

All content on this website, including text, images, logos, dyno charts, graphics and design, is the property of NZ Tuning Limited or is used with permission, and is protected by copyright and trademark law. You may not reproduce, distribute or use it without our written permission.

Brand names, trade marks and product names belonging to the manufacturers whose parts we sell remain the property of those manufacturers. We are a retailer of those products. Use of a manufacturer's name on this site identifies the product being sold and does not imply any endorsement, sponsorship or affiliation beyond our supply relationship.

11. Limitation of liability

To the fullest extent permitted by law, NZ Tuning Limited is not liable for any indirect, incidental or consequential loss arising from the use of this website, our products or our services. This includes loss of use, loss of profit, and mechanical failure or engine damage that is not caused by our negligence or breach.

Where we are found liable, our total liability is limited to the amount you paid for the product or service giving rise to the claim.

This section does not limit your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply.

12. Suspension and termination

We may suspend or refuse your access to this website, close a customer account, and refuse to accept further orders, if these Terms are breached, if fraudulent or unlawful activity is suspected, or if the site or our staff are misused or abused.

If that happens, any orders we have already accepted and you have already paid for will still be fulfilled, or refunded in full if we choose not to fulfil them.

You can close your customer account at any time by contacting us. Closing your account does not affect orders already placed, or records we are legally required to keep.

13. Changes to these Terms

We may update these Terms at any time. The revised version is posted on this page with an updated date, and applies from the date it is posted.

Where a change is material, we will notify customers who hold an account with us by email. Continuing to use the site or place orders after a change means you accept the updated Terms.

The Terms that apply to your order are the ones published at the time you placed it.

14. Complaints and disputes

If something has gone wrong, contact us first using the details below. We will acknowledge your complaint within 2 business days and work with you to resolve it.

If we cannot resolve it between us, either of us may pursue the matter through the New Zealand Disputes Tribunal or the courts, depending on the amount in question.

15. Governing law

These Terms are governed by the laws of New Zealand. Any dispute arising from them is subject to the jurisdiction of the New Zealand courts.
